ELIGIBILITY: The Better in Bed SleepStakes (the “Sweepstakes”) is open to legal residents of the United States who have a U.S. mailing address and are 18 years of age and older at time of entry (“Eligible Participants”). The Sweepstakes is being conducted as part of the Better Sleep Council’s efforts to promote Better Sleep Month. The Better Sleep Council is the consumer education arm of the International Sleep Products Association, the trade association for the mattress industry. Internet access is required to enter this Sweepstakes. See below for further details. This Sweepstakes is void in New York, Florida, Puerto Rico, Rhode Island, Hawaii, Alaska and where prohibited. The International Sleep Products Association (ISPA) (“Sponsor”), Marcus Thomas LLC (“Administrator”), Facebook, Inc., their employees, successors, affiliates, prize suppliers, and advertising and promotion agencies, and each of their respective parents, subsidiaries, affiliates, and their respective agents, representatives, officers, directors, shareholders and employees (collectively, “Releasees”), and each of their immediate family members (spouse, parents, children and siblings, and their respective spouses, regardless of where they live) and individuals living in the same households of each of these individuals, whether related or not, of the above are not eligible to enter or win. Sweepstakes is subject to all applicable federal, state and local laws. The laws of the United States and the Commonwealth of Virginia govern this Sweepstakes.

SWEEPSTAKES TIMING/DESCRIPTION: The Sweepstakes begins at 9 a.m. EST on May 4, 2018 and ends at 11:59:59 p.m. EST on May 24, 2018 (the “Promotional Period”). There are twelve (12) prizes available to be awarded in a random drawing.

HOW TO ENTER:

• The Sweepstakes will take place weekly beginning at or around 9 a.m. EST on Friday, May 4, 2018 and will conclude at 11:59 p.m. EST on Thursday, May 24, 2018.
• Timing for the Sweepstakes is as follows for each weekly period (the “Entry Period”): Entries received outside of the Entry Period or that do not adhere to the Sweepstakes rules (“Rules”) will be disqualified.
  • Entry Period 1: May 4, 2018 at 9 a.m. EST to May 10, 2018 at 11:59 p.m. EST
  • Entry Period 2: May 11, 2018 at 9 a.m. EST to May 17, 2018 at 11:59 p.m. EST
  • Entry Period 3: May 18, 2018 at 9 a.m. EST to May 24, 2018 at 11:59 p.m. EST
• There will be one (1) Facebook post during each of the three (3) Entry Periods published on behalf of Sponsor. Participants must log in to their Facebook account, visit the Better Sleep Council Page at https://www.facebook.com/BetterSleepOrg/ and comment on a post to win one (1) prize during the corresponding designated Entry Period. That comment serves as the official entry.
• Comments must be relevant to the challenge and include the hashtag #BetterInBed. Players may enter only once per post for a total of three (3) entries. There will be four (4) winners per post, and no duplicate winners within each Entry Period. In the case where one player is selected for more than one prize, an alternate will be selected.
• The Administrator will manage the entries, conduct the drawings and distribute the prizes. All eligible entries will be randomly selected for each of the twelve (12) prizes.

DETERMINATION OF WINNERS: Twelve (12) winners will be selected in a random drawing on or about June 1, 2018 from among all eligible entries. Potential winners will be notified on or about June 11, 2018 via direct message on Facebook, and they will be required to sign an affidavit of eligibility/liability release and federal and state tax release, and where legal, a publicity release. Potential winners must return these documents, properly executed, via fax or email, within 72 hours of time of notification, and the original documents, via regular U.S. mail, within 10 days of date of notification. A potential winner’s non-compliance with these deadlines or other aspects of these Official Rules or the Sponsor’s inability either to contact a potential winner or to deliver the prize or prize notification to a potential winner within a reasonable time period, will result in such potential winner being disqualified. At Sponsor’s sole discretion, a prize will be awarded to a potential alternate winner. Allow three weeks for delivery of prizes following completion of winner verification process.

SPONSOR’S DECISIONS FINAL AND BINDING: The results of the random drawing, all decisions by Sponsor, its agents or judges related to whether an entry complies with the Official Rules, and the interpretation by Sponsor or its agents of these Official Rules, are final and binding on all entrants and other participants as to all aspects of this Sweepstakes.

ODDS: The odds of winning a Prize depend upon the total number of eligible entries received and the number of prizes.

PRIZES: For each of the weeks outlined below, four (4) winners will be randomly selected and the prize must be shipped to a U.S. mailing address:

• May 4-10, 2018: Four (4) $50 Amazon gift cards
• May 11-17, 2018: Four (4) $50 Amazon gift cards
• May 18-24, 2018: Four (4) $50 Amazon gift cards

The aggregate Approximate Retail Value for all prizes is $600. No substitutions, cash equivalents or transfer of prizes permitted except at the sole discretion of the Sponsor, who reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, except as otherwise provided herein. All taxes, and any other costs and expenses associated with prize acceptance and use not specifically stated within these Official Rules as being provided, are the sole responsibility of the winner, including, without limitation, all federal, state and local taxes. Winners will be provided an IRS Form 1099 in recognition of the prize amount. If a winner is at least 18 years of age but still considered a minor in his/her state or place of residence, the prize may be awarded in the name of his/her parent or legal guardian, who will be responsible for fulfilling all requirements imposed on potential winners set forth herein. All prize details are at Sponsor’s sole discretion.

NOTIFICATION OF POTENTIAL PRIZE WINNERS: Winners will initially be contacted via Facebook and must send their contact information via direct message. Upon receipt of the acceptable documentation, the Administrator will issue the prize on behalf of Sponsor.

CONDITIONS OF PARTICIPATION: By entering, entrants agree to be bound by these Official Rules, including all eligibility requirements and the decisions of the Sponsor and Administrator and their employees, which are final and binding. By entering the Sweepstakes or accepting a prize, each winner consents to the use of his/her name, address (city and state), image, likeness, photograph, voice and all other material submitted with the entry, and biographical material for advertising, publicity and promotional purposes by Sponsor, or party designated by the Sponsor, in any and all media now known or hereafter devised, including but not limited to, the internet, worldwide in perpetuity, without additional compensation, notification or permission, except where prohibited by law. By entering you irrevocably release and hold harmless Releasees from any claims, actions, injury, loss or damage of any kind, including but not limited to personal injury or death, resulting, directly or indirectly, in whole or in part, from participating in this Sweepstakes or from the acceptance, possession or use or misuse of a prize, or from Sponsor or Sponsor’s designees’ use of a winner’s image, likeness, photograph, voice or biographical material. This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages; loss of data, income or profit; loss of damage to property; and claims of third parties. Entrants agree that Releasees have not made nor are in any manner responsible or liable for any warranty, representation or guarantee, statutory, express or implied (including but not limited to the implied warranties of merchantability, title and fitness for a particular purpose), in fact or in law, relative to the Sweepstakes. Entrants agree that they have full legal right to submit all information, images and other materials submitted as part of the entry.

GENERAL: Sponsor will collect information from the entrants solely for the purpose of promoting Better Sleep Month and the Sweepstakes, to conduct the random drawing, and to notify the potential winners. Sponsor will not share this information with any third party, except as necessary to promote Better Sleep Month, to administer the Sweepstakes or notify a potential winner, as applicable. Sponsor reserves the right, in its sole discretion, to cancel or suspend part or all of this Sweepstakes at any time without notice for any reason, including if in the opinion of the Sponsor, its agents or judges there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if a virus, worms, bugs, nonauthorized human intervention or other causes corrupt or impair the administration, security, fairness, or integrity and proper play or submission of entries of the Sweepstakes. In the event of cancellation or termination, Sponsor may, at its sole discretion, void any entries it suspects are at issue and award the prizes in a random drawing from among all non-suspect, eligible entries received up to the time of cancellation (or earlier date determined in the Sponsor’s sole discretion if cancellation occurs after the close of the Promotion Period). Sponsor may at its sole discretion void any entries that it considers to be in bad taste. Caution: Any attempt by an entrant or any other individual to deliberately damage the website or undermine the legitimate operation of the Sweepstakes may be in violation of criminal and civil laws, and, should such an attempt be made, the Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law, including criminal prosecution. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. Sponsor reserves the right in its sole discretion to disqualify entrants who violate these Official Rules or interfere with this Sweepstakes in any manner. If an entrant is disqualified, Sponsor reserves the right to terminate that entrant’s eligibility to participate in the Sweepstakes (and void all associated entries). By entering, you also acknowledge that this Sweepstakes is in no way sponsored, endorsed, administered by, or associated with Facebook, Inc.

DISPUTES: Sponsor shall have the sole and exclusive authority to resolve all disputes relating to this Sweepstakes, and all such decisions shall be final and binding. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Eligible Participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Virginia, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Virginia.

Computer systems of the Administrator are the official time-keeping devices for this Sweepstakes. In the event of a dispute as to who submitted a particular entry, Sponsor shall resolve such dispute by deciding in its sole discretion who is the primary person in whose name a Sweepstakes entry was made. Entries become the property of the Sponsor and will not be acknowledged or returned. Incomplete entries or entries not complying with these Official Rules are subject to disqualification, at the Sponsor’s sole discretion. Entries that have been generated by a script, macro, bot or any other automated means or any means which subvert the entry process will be deemed void.

WINNERS’ NAMES: For the names of the winners, available after June 22, 2018, mail a self-addressed, stamped envelope by no later than June 29, 2018 to: International Sleep Products Association, Sweepstakes Results, 501 Wythe Street, Alexandria, VA 22314.
